An appropriation of money by special warrant, prepared on direction of the Governor in Council, to be signed by the Governor General.

OBS

Occasionally, circumstances arise whereby an urgent expenditure becomes necessary at a time when Parliament is not in session, and there is no appropriation pursuant to which payment may be made. This could occur when Parliament is dissolved during a period of interim supply. Section 23 of the Financial Administration Act, which permits the appropriation, is applicable whenever Parliament is dissolved or when it has been adjourned either for an unspecified period or until a date more than two weeks after the date of the order directing that the warrant be issued. A Governor General's Warrant is an appropriation for the fiscal year in which it is issued. The following conditions apply: 1. The warrant must be issued in the fiscal year in which the expenditures are required; 2. The unspent balance lapses at the year-end; 3. The appropriation is subject to commitment and expenditure control.

Cette situation pourrait se présenter lorsque le Parlement est dissout au cours d'une période de crédits provisoires. L'article 23 de la Loi sur la gestion des finances publiques qui autorise l'attribution de crédit, s'applique lorsque le Parlement est dissout ou prorogé, ou lorsqu'il est ajourné soit pour une période indéterminée, soit pour plus de deux semaines à compter du jour de l'arrêté ordonnant que le mandat soit émis. Le mandat constitue un crédit pour l'année financière où il est émis. Les conditions suivantes s'appliquent : 1. le mandat doit être émis pendant l'année financière dans laquelle les dépenses sont requises; 2. le solde non dépensé est annulé à la fin de l'année; 3. le crédit est soumis au contrôle des engagements et des dépenses.

A warrant, prepared by order of the Governor in Council during dissolution or adjournment [of the Parliament], which, when signed by the Governor General, authorizes the payment of funds to meet an urgent need.

CONT

Governor General's special warrants. Where a payment is urgently required for the public good when Parliament is not in session and there is no other appropriation pursuant to which the payment may be made, the Governor in Council, on the report of the President of the Treasury Board that there is no appropriation for the payment and the report of the appropriate Minister that the payment is urgently required for the public good, may, by order, direct the preparation of a special warrant to be signed by the Governor General authorizing the payment to be made out of the Consolidated Revenue Fund.

En l'absence de crédit, le gouverneur en conseil peut, par décret, ordonner l'établissement d'un mandat spécial pour la signature du gouverneur général en vue d'autoriser un paiement sur le Trésor si le Parlement n'est pas en session, le président du Conseil du Trésor lui remet un rapport attestant l'absence de tout crédit pouvant autoriser le paiement et le ministre compétent lui remet un rapport attestant l'urgence du paiement et sa nécessité dans l'intérêt public.

OBS

Ces mandats ne sont habituellement valables que pour un mois et, pour fins de contrôle, ils sont fondés sur les crédits du Budget des dépenses qui a été déposé ou dont le Conseil du Trésor a approuvé le dépôt (Budget principal ou Budgets supplémentaires). Les dépenses législatives, comme les prestations d'assurance-chômage, ne sont pas visées par les mandats spéciaux puisqu'une loi les a déjà autorisées.
