NON ULTRA PETITA [1 record]

Record 1 2026-03-09

English

Subject field(s)
  • Decisions (Practice and Procedural Law)
CONT

It is a long-standing rule that a court of common law will not grant a successful plaintiff more than what was asked for in the plaintiff's prayer for relief. A judgment which is ultra petita may be successfully appealed as it is not good in law.

OBS

Although the designation "non ultra petita" seems to be an antonym of the designation "ultra petita", it is not. It means the same thing in Latin as "ultra petita": not beyond the request.

French

Domaine(s)
  • Décisions (Droit judiciaire)
CONT
