Although obtaining a valid consent from patients has always involved explanations about the general nature of the proposed treatment and its anticipated effect, the Supreme Court of Canada, in 1980, imposed a more stringent standard of disclosure upon physicians. The adequacy of consent explanations is to be judged by the "reasonable patient" standard, what a reasonable patient in the particular patient's position would have expected to hear before consenting.

... it is for the court to lay down the general standard of care exacted by law .... This will ordinarily take the form of an incantation of the traditional formula of the reasonable and prudent man. In a few situations, however, the legal standard of reasonable conduct has been defined with greater precision. E.g. the care which an occupier must observe for the safety of persons who have come upon his land has been meticulously formulated in accordance with a fine graduation of standards corresponding to the degree of benefit which he derives from their visit.

The test for identification is the same as for defamatory meaning: would a sensible reader reasonably identify the plaintiff as the person defamed? Here also the standard of reasonableness is not high: the ordinary reader of a newspaper article ... is not expected to read "with cautions and critical analytical care"; he may read "casually and not expecting a high degree of accuracy" and indulge "in a certain amount of loose thinking" and even "rather far-fetched inferences".
