En premier lieu, le principe de subsidiarité vise à garantir que l'espace réservé aux entités fédérées dans le quotidien du fédéralisme soit protégé. Ce principe pose essentiellement qu'une compétence relève du pouvoir public situé «le plus près du citoyen», sauf démonstration qu'un pouvoir public plus éloigné (et dans certains régimes, plus «élevé») est mieux outillé pour atteindre l'objectif politique visé. Le principe comporte donc une présomption réfragable de proximité, combinée à une évaluation de l'efficacité et à une obligation de justification d'intervention du pouvoir «plus éloigné» du citoyen.
