Situation de conflit d'intérêts dans laquelle l'intermédiaire ou l'agent financier ne prend pas les mesures nécessaires pour se soustraire à cette situation ou pour empêcher que son client ne subisse un préjudice. Le conflit d'intérêts n'est pas illégal en soi, car un certain nombre de mesures sont prévues en pareil cas. Les conflits d'intérêts ne sont généralement pas une menace pour la solvabilité des institutions, mais ils en sont une pour les intérêts du client. Et pour la plupart des intermédiaires, un code de déontologie prévoit des sanctions disciplinaires à l'endroit des contrevenants.
