In Hinz v. Berry, the distinction between compensable and non-compensable damage was dramatized. It was held that the damage resulting from the shock of witnessing the accident was recoverable, but damages were denied for depression resulting from grief and sorrow for a lost husband, anxiety about the welfare of children injured in the accident, financial stress because of the loss of a breadwinner, and the need for adjusting to a new life.

La distinction entre dommages indemnisables et dommages non indemnisables fut nettement établie dans l'affaire Hinz c. Berry. Il fut en effet statué que les dommages résultant du choc d'avoir assisté à l'accident donnait droit à réparation, mais que des dommages-intérêts ne pouvaient être accordés pour la dépression découlant du chagrin éprouvé de la perte d'un mari, de l'anxiété au sujet du sort des enfants blessés dans l'accident, des soucis financiers créés par la perte du soutien de famille ainsi que de la nécessité de s'adapter à une nouvelle vie.

... the losses suffered by the plaintiff company, in the form of the devaluation of its assets, were recoverable losses, since this was within the contemplation of the defendant company, as a natural and probable result of its failure to provide financing for the plaintiffs to buy cars from the defendant, in view of the knowledge of the defendant company of the plaintiff company's financial state and prospects.
