jus cogens : [En vertu de l'article 53 de la Convention de Vienne sur les droits des traités] : [...] est nul tout traité qui, au moment de sa conclusion, est en conflit avec une norme impérative du droit international général. Aux fins de la présente Convention, une norme impérative du droit international général est une norme acceptée et reconnue par la communauté internationale des États dans son ensemble en tant que norme à laquelle aucune dérogation n'est permise et qui ne peut être modifiée que par une nouvelle norme du droit international général ayant le même caractère.

jus cogens : Règles impératives en droit international public. En droit privé, les lois sont généralement supplétives de la volonté des cocontractants; elles sont cependant impératives quand elles intéressent l'ordre public (C.C.Q., art. 9). Parfois, pour éviter la difficulté de savoir si une disposition est d'ordre public, la loi prévient que l'on ne peut déroger (e.g. art. 2414 C.C.Q.; art. 2500 C.C.B.-C.).
