OBS

The purpose of the Register of Trademarks shall be the recording of applications for the registration of trademarks, trade names and business signs, and of instruments and contracts pertaining to transfers, licensing and rights "in rem," and also of any other instruments, both optional and mandatory, that concern applications for registration, either pending or already granted, with the effects provided for in the Law.

There shall be kept under the supervision of the Registrar ... a register of trade-marks and of transfers, disclaimers, amendments, judgements and orders relating to each registered trade-mark.

Laws generally only protect marks against infringement of registered in the (State) trademarks register. Otherwise anyone else can register and even prohibit the use by the original owner.

According to the Canadian dictionaries consulted, "trademark" is the preferred spelling.
