This third standard should be whether the decision of the Tribunal is unreasonable. This test is to be distinguished from the most deferential standard of review, which requires courts to consider whether a tribunal’s decision is patently unreasonable.

Cette troisième norme devrait être fondée sur la question de savoir si la décision du Tribunal est déraisonnable. Ce critère doit être distingué de la norme de contrôle qui appelle le plus haut degré de retenue, et en vertu de laquelle les tribunaux doivent dire si la décision du tribunal administratif est manifestement déraisonnable.
